For the purposes of these terms and conditions, you means the user of this website (and your has a corresponding meaning) and we or Airways means Airways Corporation of New Zealand Limited (and our and us have a corresponding meaning).
These terms and conditions apply to your use of and access to this website (Website, which for clarity includes all content on the Website). Any such use and/or access will be deemed to be acceptance of these terms and conditions.
We reserve the right to update these terms and conditions from time to time and your continued use of and access to the Website will be deemed acceptance of any updated terms and conditions. Any update to these terms and conditions will be effective from the time they are posted on the Website.
The Website is made available to you for the purposes of obtaining access to the Internet Flight Information Service (IFIS).
You will use the Website in a manner that is at all times consistent with these terms and conditions and all applicable laws, rules and regulations.
You must not interfere, damage, undertake any unauthorised upload or modification or otherwise harm the Website (or any related system or network), including any attempt to do so.
You must not use any spider, robot, scraper, deep-link or other automated device or means to use
or access the Website (or any part of the Website) without our prior written agreement.

Unauthorised attempts to upload or modify information or interfere in any other way with this website or the information contained on it are strictly prohibited and may result in prosecution.
Attempts to access information to which you are not authorised through the Website are strictly prohibited and may result in prosecution.
Website activity is monitored to identify unauthorised access and interference.
Meteorological information supplied is strictly not for use by Commercial Operators conducting flights at or below 10,000ft, commercial flight training organisations,or flying/aero clubs providing commercial flight training.
When you register you provide various personal details such as your name and telephone number. This information is stored in a secure database and will be used only for the purposes of operating the Website. Your details will not be passed onto any other organisation.
You can view and update the information you have provided at any time by logging in and going to the Change User Details page under the User Account menu.
In addition to the details you provide when registering, the server will record the specific transactions you perform. This information will only be used for statistical purposes.
Web server logs are also kept for the purposes of generating site usage statistics and performing security auditing. The logs record information every time you request a page from the server. This information will not be used to identify you except in the event of irregularities in your use of the site. The information logged includes:
Cookies are small pieces of information that a website can store on your computer through your web browser. The Website uses cookies only for temporarily maintaining your user session - the cookies will not be stored to your hard disk. Your session records whether you have logged in so you don't have to provide login details for every page you request. Your session will expire after you log out or if you don't request any pages from the server for 20-30 minutes.
In order to use the IFIS site your browser must be configured to accept cookies. You can usually configure your browser to warn you before accepting cookies if you wish.
Your user details and password are stored in a secure database with your password being encrypted before being stored. Whenever your user details or password are transmitted between the server and your browser the details are transmitted over Secure Sockets Layer (SSL).
We will not accept responsibility for any corruption or changes to data that may occur in the Internet transport system.
Pre-Flight Briefings obtained from IFIS are terminated with the text string:

If this does not appear the briefing is incomplete and another briefing request must be submitted.
IFIS is dependant on the availability of the Internet and the Airways AIM database. The Website and IFIS are provided on an "as available" basis and we do not warrant that the Website or IFIS (or your use of them) will be error free or uninterrupted.
The Website and/or the AIM database may be withdrawn at times for maintenance. This is normally scheduled after 2100 local time.
If IFIS is not available, users should contact the National Briefing Office on 0800 626 756 (landline users only) or 03 358 1509 (cellphone users).
In order to keep the IFIS Webserver running as efficiently as possible, a number of housekeeping functions are performed at the start of each month. One of these is the deregistration of IFIS users who have not logged onto the system in the past 12 months. Users who have been deregistered will need to re-register (the same username can be re-used) before they can use the system again. In order to keep your IFIS username current and avoid having to re-register, all you need to do is log onto the IFIS system at least once every twelve months.

In the event of any inconsistency between the Standard Terms and these terms and conditions,
the Standard Terms will prevail.

Note the Website should be usable under older browsers, but some features may not work (such as clicking the map to select areas for the Area (NZ) Briefing). Testing is only done with recent versions of the major browsers (Chrome, Firefox, Internet Explorer) as it is not practical to test all browsers. Note: It is recommended to keep your browser up-to-date for security reasons.
We (and our licensors) own all proprietary and intellectual property rights in the Website and the software and other materials associated with the Website. You must not copy, reproduce, modify, adapt, distort or vary the Website by any means or in any form without our prior written consent.
To the maximum extent permitted by law, we (and our licensors) shall not be liable for any loss, damage, expense and costs incurred or suffered through the direct or indirect use of or reliance upon the information on the Website. Without in any way limiting the foregoing, we shall not in any circumstances be liable for any indirect loss, loss of profits, loss of revenue, or loss of savings or for any indirect, consequential, special, exemplary, or incidental damages arising from or occurring in connection with these terms and conditions or anything associated directly or indirectly with the Website.
Subject to the provision immediately above, we will have no liability to you for any act, omission or failure associated with the Website arising from any cause beyond our reasonable control.
You agree to indemnify and hold us (including our officers, employees and agents) harmless and keep us indemnified, from and against all loss, liability, actions, proceedings, costs, expenses (including legal fees), claims and damages incurred or suffered by us arising from your access to and/or use of the Website and/or breach of these terms and conditions.
No failure, delay or indulgence by us in exercising any of our powers or rights under these terms and conditions will operate as a waiver of such powers or rights. These terms and conditions supersede all prior agreements, arrangements, representations and undertakings between you and us and constitute the entire agreement between you and us in relation to t he subject matter of these terms and conditions.
These terms and conditions are governed by the laws of New Zealand. You and we both submit to the non-exclusive jurisdiction of the courts of New Zealand.
